U.S. Department of Labor Issues New FMLA Forms

The Genetic Information Nondiscrimination Act (GINA), prohibits employers from discriminating against employees on account of their genetic information, which includes an individual’s genetic tests, or the genetic tests of an individual’s family member(s). GINA also strictly limits an employer’s collection or disclosure of employees’ genetic information.

The U.S. Department of Labor recently updated its Family Medical Leave Act (FMLA) forms to include an additional disclosure related to the GINA prohibitions. The new FMLA forms specifically alert the employee’s healthcare provider to refrain from providing any information regarding the employee’s genetic tests, genetic services or the manifestation of disease or disorder in the employee’s family.

If your company is using the U.S. Department of Labor’s FMLA forms, it is recommended that you begin using the new version issued in May 2015. If you need more information regarding FMLA or GINA, please feel free to contact us.
