I-9 and E-Verify Compliance, Flat Fee Assessment Service

What Employers Need to Know:

  • Government audits regarding the I-9 verification process have increased.

  • Employers may be subject to penalties if their I-9 records are incorrect, even if the entire workforce is lawfully authorized to work.

  • I-9 penalties can easily hit six or even seven figures (ex. Minnesota company fined $227,000 for deficient I-9 process, despite 100% lawfully authorized workforce; Washington orchard fined $2.25 million for deficient I-9 records and hiring undocumented workers).

  • No company can be too small to be subject to I-9 penalties (ex. Maine mom and pop convenience store with only two employees, both U.S. citizens, were subject to penalty for I-9 violations).

  • I-9 violations may also lead to criminal liability (ex. Iowa dairy farmer convicted in federal court for harboring illegal aliens for financial gain).

  • An improper I-9 verification process may lead to discrimination claims against the employer (ex. Nevada taxi company fined $445,000 for citizenship status discrimination in the I-9 process).

About the Compliance Assessment Legal Services:
The purpose of the Compliance Assessment Service at DeWitt LLP is to minimize the costs and risks associated with improperly completing the I-9 verification or the E-Verify process. A brief review of select I-9 records may reveal whether or not the company has been following the proper procedures. The assessment could spot common or systemic mistakes such as:

  • Using the wrong I-9 form version

  • Improperly completing Form I-9

  • Verifying incorrect types or combinations of documents

  • Failing to re-verify when required

  • Failing to properly maintain I-9 records

What Does the Compliance Assessment Include and How Much Does It Cost?
We offer this I-9 Compliance Assessment for a flat fee. The assessment will include:

  • Review of a limited portion of the employer’s I-9 forms and associated documents for purposes of identifying errors or recurring problems;

  • Our findings and recommendations;

  • A consultation (up to 30 minutes), to provide you with practical tips and information on how to avoid the traps and pitfalls of the I-9 verification and, where applicable, the E-Verify process.

If the assessment reveals the need for a more comprehensive internal audit, the additional review, if requested, will be billed separately at regular hourly rates.
