Brian is a partner in DeWitt's Green Bay office.  For many of his clients, Brian takes on the role of corporate counsel, advising them on all aspects business law.  His practice focuses on business transactions, banking, litigation, real estate, and employment law.   When matters heat up and litigation arises, Brian’s even-keeled manner provides his clients with the benefit of cool-headed reasoning to achieve the litigation objectives.  He works closely with his clients to build an attorney-client partnership that focuses on collaborative decision making and strategic direction.

He is adept at negotiating and drafting agreements, resolving commercial/business and civil disputes, analyzing breach of contract claims, leasing of commercial real estate, protecting creditors’ rights, navigating construction disputes and liens, advising on shareholder disputes, addressing insurance issues, reviewing product liability claims, appellate actions and providing counsel on other general business planning and real estate matters.

In the area of employment law, Brian works with businesses on a variety of matters including wrongful discharge/discrimination complaints, drafting employee handbooks, employment law litigation, non-compete and confidentiality agreements, and assisting with employment transition issues.

Notable Representations

  • Successfully obtained summary judgment on behalf of a franchisor early in a wrongful death claim.  The case continued against various co-defendants for another five years after the client was dismissed and the remaining co-defendants ultimately agreed to settle the matter for over $4 million dollars
  • Represented a corporation being sued for copyright and trademark infringement and was able to secure a resolution in which the client paid less than 10% of the statutory damages being claimed as a settlement
  • Successfully worked with five secured lenders on a forbearance which allowed a client to sell the assets of business for a price in excess of the amount of the loans such that the client’s personal guaranties to the lenders were satisfied
  • Represented a retail client in a claim for false imprisonment of a minor.  After depositions had commenced, convinced plaintiff to voluntarily dismiss the case against the client
